  1. Introduction

    1. Transaction Solution International (India) Private Limited (hereinafter referred to as ‘we’ or ‘us’ or ‘our’ or ‘the Company’, which terms shall mean and include our authorised service providers) values the trust of its users (hereinafter referred to as ‘user’ or ‘you’) and is committed to protect it in all respects. The Company is aware that it will be dealing with personal and/ or sensitive personal data. This privacy policy (‘Privacy Policy’) sets out how the Company collects, uses, retains, discloses, shares, and safeguards the user’s information/ data.

    2. When the user visits the website(s) of the Company (‘Website’) or registers itself with the Company to access the services provided by the Company (‘Services’) provided by the Company, the user confirms that the user understands, agrees and consents to be bound by the terms and conditions of this Privacy Policy. The user hereby provides consent to the Company as required under the Information Technology Act, 2000 and rules and regulations made thereunder ( ‘IT Act’ ), for the purposes specified hereunder. By using the Website and Services, the user expressly gives the Company consent to use, retain and disclose personal information in accordance with this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use, or access the Website and Services.

    3. This Privacy Policy is to be read with FINDIPAY Terms and Conditions and Terms of Use applicable to the Website and Services, as available on our website.

    4. The Company reserves the right to make changes to this Privacy Policy at any time and for any reason whatsoever with or without any prior notification. The user is encouraged to periodically review this Privacy Policy to stay informed of the updates. In case of any substantial/ significant change, we will inform the user regarding the same either through email, or SMS, or telephone calls. You will be deemed to have accepted the changes and the revised form of the Privacy Policy from the date of your continued use of the Website and Services.

  2. Collection and Retention of Data

    1. In general, you can browse the Company’s Website without telling us who you are or revealing any personal information about yourself. Upon registering yourself as a user of the services provided by the Company, you are required to provide us with certain personal information, including, inter alia, your name, date of birth, mobile number, email address, address/ location, official identification document type and number, transaction history, billing address, IP address, bank account details, a credit/ debit card number, credit/ debit card expiration date and/ or other payment instrument details (“Customer Data”). Customer Data may include sensitive personal data as defined under the IT Act.

    2. If you choose to post messages on our message boards, blogs or other message areas or leave feedback, we will collect that information you provide to us and form part of Customer Data.

    3. If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Website, we may collect such information into a file specific to you which also form part of Customer Data.

    4. We do not request any more information/ data than what is reasonably required to provide the requested Services, and as required under applicable law. We assume that the information/ data provided by you is true, accurate, current, non-misleading, consistent, and relevant. We allow you to view and/ or update your Customer Data in accordance with Company policy; at any point of time to ensure that only the most updated, accurate and relevant information/ documents are stored with us as it allows us to provide you with a personalised, efficient, and customized experience.

    5. You always have the option to not provide any Customer Data by choosing not to use the Services or a particular functionality or feature on the Website. The Company may automatically collect certain data/ information when you register to use the Services based upon your behaviour on the Website and use of the Services. This information may include the URL that you just came from (whether this URL is on our Website or not), which URL you next go to (whether this URL is on our Website or not), your computer browser information, and your IP address.

    6. Any Customer Data provided to or collected by the Company under this Privacy Policy will be stored and retained by the Company and/ or any other person duly authorized by the Company from time to time, in accordance with this Privacy Policy and applicable law.

    7. The Company will not retain such Customer Data for a period longer than it is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force.

  3. Tracking of Data - Cookies

  4. Use of Data

    1. The Customer Data that the user provides for/ while using the Website and Services, and that is collected by the Company, may be used by the Company for purposes including the following:

      1. To enable the user to use, access, and avail the Services provided by the Company.

      2. To improve the content and functionality of the Website and Services provided by the Company, to create new features, promotions, and service by storing, tracking, and analysing user preferences and trends, and for business development.

      3. To do internal research on the users' demographics, interests, and behaviour to better understand, protect and serve the users. This information is compiled and analysed on an aggregated basis.

      4. To facilitate effective communication, for training and quality purposes, resolution of grievances between the Company and its users.

      5. To send the user communications, such as updates, account information or to notify the user of technical updates or changes in the Website and Services and/ or the Company’s policies, and/ or marketing and promotional messages through any mode of communication regarding the functionalities/ features available on the Website including any details in relation to the Services provided by us or any information which we choose to communicate to you from time to time.

      6. To comply with applicable laws in relation to financial services including retention of financial information and transactions and other applicable laws in relation to use/ storage/ transfer of information.

      7. To offer services and features that most likely meet the user’s needs and to provide other value-added services, including but not limited to:

        1. provision of real time notifications via SMS and/ or electronic mail regarding missed calls;

        2. recording of incoming and outgoing calls for the purposes of provision of call analytics such as understanding the manner in which your business functions, provision of training and analyzing call patterns, agent productivity, team efficiency, etc;

        3. provision of actionable insights in the form of details of key metrics such as data of callers and the time, type and date of calls, in order to optimize our team’s effort and to better understand customer behaviour;

        4. provision of access to the Customer Data through the customer relationship management tool using the Company’s programmable application programming interfaces;

        5. provision of call making facility from a Google Chrome plugin or extension designed/ provided by the Company or its subsidiary or third party providers authorised by the Company that allows our team to make calls directly from your web browser.

      8. To complete optional online surveys which may ask you for contact information and demographic information (like zip code, age, gender).

      9. To provide customer support, troubleshoot problems, and respond to product and service requests made by the user, as permitted by applicable law.

    2. By using the Website and Services, and on procuring quotations therein, the user hereby authorizes the Company to contact the user via calls, mails and/ or text messages on the contact details so provided, to furnish the user with information with regards to the services and products of the Company. This authorization shall be licit/ applicable for the mentioned purposes irrespective of whether the user is registered with the NDNC registry.

  5. Transfer of Data

    1. The Company works closely with its subsidiaries, affiliates and third parties engaged by it during the provision of the Services. The user hereby acknowledges and agrees that the Company may disclose the Customer Data to its subsidiaries, affiliates and authorized third parties engaged by it, which may or may not be located within India, under the following circumstances:

      1. To help detect and prevent identity theft, fraud, and other potentially illegal acts; correlate related or multiple accounts to prevent abuse of our Services.

      2. To facilitate joint or co-branded services that the user requests where such services are provided by more than one corporate entity. Those entities and affiliates may not market to you as a result of such sharing unless you explicitly opt – in. However, in any such cases, the Company shall make reasonable commercial efforts to ensure that such subsidiaries, affiliates and authorized third parties keep such portions of the Customer Data that they may receive from the Company confidential as per applicable laws.

      3. With your consent, or with an opportunity for you to withdraw consent, the Company may share your information with third parties for marketing purposes, as permitted by applicable law.

      4. The Company may use third-party advertising companies to serve ads when you visit the Website. These companies may use information about your visits to the Website that are contained in web cookies in order to provide advertisements about goods and services of interest to you.

    2. The Company may share Customer Data with third parties that perform Services for the Company or on the Company’s behalf, including payment processing, data analysis, email delivery, hosting services, business development, customer service, and marketing assistance in a good faith belief that such disclosure is reasonably necessary to:

      1. take action regarding suspected illegal activities;

      2. enforce or apply our Terms of Use and this Privacy Policy;

      3. comply with legal process, such as a search warrant, subpoena, statute, or court order, investigate or remedy potential violations of our policies, protect the rights, property and safety of others;

      4. make disclosures as required by any applicable law, rules, regulations or regulatory authorities thereunder; or

      5. protect our rights, reputation, and property, or that of our users, affiliates, or the public.

    3. While sharing Customer Data with third parties, as described above, we will ensure that such third parties are subject to this Privacy Policy and/ or follow practices at least as protective as those described under this Privacy Policy.

    4. The Company and our affiliates will share some or all of the Customer Data with another business entity, should the Company (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business. Should such a transaction occur, the other business entity (or the new combined entity) will be bound by this Privacy Policy with respect to the Customer Data.

  6. Security

    1. The Company implements reasonable security practices and procedures as mandated under the applicable laws including the IT Act and have implemented necessary internal control measures that are commensurate with respect to the information being collected and the nature of our business.

    2. Our subsidiaries, affiliates, and third parties engaged by us are in compliance with all applicable law and we do not possess, or otherwise store, process, or transmit data relating to the card/ payment card details on behalf of the user. However, we receive transactional data of the customers through our merchants/ distributors/ franchises.

    3. We restrict access to your Customer Data to our employees, contractors and agents on a need-to-know basis, in order for them to process such Customer Data for us, and who are subject to strict contractual confidentiality obligations.

  7. Links to other websites

    1. The Company’s Website may contain links to other websites that may collect the user’s Customer Data.

    2. The Company will be not responsible for the privacy practices or the content of those linked websites. We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly to intimate them of the same.

  8. Links to other websites

    1. The Company provides all users with the opportunity to opt – out of receiving non-essential (promotional, marketing-related) communications from the Company on behalf of our partners, and from the Company in general, after setting up an account.

    2. If you want to remove your contact information from all mailing lists and newsletters, please contact us at contact@findipay.in with such request.

    1. By using the Website and Services and/ or by providing the Customer Data, you consent to the collection and use of the Customer Data disclosed on the Website in accordance with this Privacy Policy, including but not limited to your consent for sharing the Customer Data as per this Privacy Policy.
